US Court Orders Freedom of Kilmar Abrego Garcia from ICE Detention

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks lawful basis.

"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The case stems from a erroneous removal to El Salvador in March, which US authorities later admitted was an error. After his repatriation to the United States to face human smuggling allegations, he was held in federal detention.

In her decision, the court pointed out that the government lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The legal challenge involve disputed assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.

He has also pleaded not guilty to the smuggling counts, which are part of a separate trial in the state of Tennessee.

The judge, who was overseeing his challenge to deportation in a Maryland district court, ruled that he must now comply with the terms of his release from custody in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
